Due to the global financial crisis many Technology companies are announcing layoffs nearly every day, and thousands are losing their jobs. Now pressure is being placed on companies to consider the nationality of workers when planning workforce reductions. Newspapers reports that when Microsoft and Intel announced its cut last week, one U.S. senator said the company should give job priority to U.S. citizens over foreign workers on special H1-B visas.<\/p>\n

Sen. Charles Grassley of Iowa wrote in a letter to Steve Ballmer, the Microsoft’s CEO: “Microsoft has a moral obligation to protect American workers by putting them first during these difficult economic times,”. According to Microsoft, the company will reduce up to 5,000 programmer positions in the next 18 months and the first 1,400 will be foreigners who are in the United States on special work visas. However, these are mostly programmers but not software engineer who design and architect systems since Microsoft could not hire enough of these high demand skills.<\/p>\n

According to David Kussin, an immigration attorney: ” There are no federal laws that require that H1-B holders should be the first to be laid off. In fact, the law is very well designed to say that U.S Companies must treat special H-1Bs workers the same as U.S. citizens in all regards, because the U.S still need more knowledge workers. However, when H1-B workers do lose their jobs, they are no longer eligible to be in the United States, and they generally have a 60-day grace period in which to find a new job”.<\/p>\n

The Sanjose Mercury News interviewed two H-1B workers who are in a perilous situation. One, called “Prasad,” from India. His position at a Silicon Valley company was cut in December, and the company agreed to keep him on for two more months to give him time to find a new job. So far, he’s had no luck. “I just need to find a new job” soon, he told The Mercury News. “There’s a distinct possibility that I will have to leave the U.S. The downturn has come, companies have stop hiring, I’m in the wrong company, I study the wrong career, I should not focus on programming and webside, I should have known better when I was in school that programming job is going away in the U.S and interesting enough – to my country: India.”<\/p>\n

Another, “Vijay,” also from, India told the The Mercury News, “I have a very limited time within which to find work before my status becomes illegal in the United States.In this kind of market, it’s too short a time within which to find new job, but I could easily finding job back in India because Indian companies are still hiring programmer for outsourcing works” he added.<\/p>\n

According to several newspapers, even when most tech companies are planning to reduce staff but certain skills still remain hot and hard to find qualified workers. The poll, taken in the fourth quarter of 2008, shows that although companies are reducing staff in some areas but they also plan to add staff in others. The majority of programming jobs will be eliminated because they can be outsourced to low cost countries but software engineering jobs are being added to design and architect systems. The current trend is that the requirements, architect and design systems would be conducted in house then the implementation or coding and testing would be outsourced to lower cost suppliers, eventually the software products will be bring back to integrate with others systems. Workers with software engineering skills and expertise in requirements, architect, design and integration should fare especially well in this weakened job market, according to the study.<\/p>\n
